2月10日,環(huan)保(bao)部網站(zhan)發布《關于(yu)推進環(huan)境監測服務社會化的指導意見》。意見提出,全面放開服務性(xing)(xing)監測市場,有序放開公益(yi)性(xing)(xing)、監督性(xing)(xing)監測領域。

關于推進環境監測服務社會化的指導意見

  各(ge)省、自治(zhi)區(qu)、直轄(xia)市(shi)環(huan)境(jing)保(bao)護(hu)廳(局(ju)),新(xin)疆生產(chan)建設兵團環(huan)境(jing)保(bao)護(hu)局(ju),解放軍(jun)環(huan)境(jing)保(bao)護(hu)局(ju),遼河保(bao)護(hu)區(qu)管理局(ju):

  為全面深化(hua)(hua)生態文明(ming)體制改革,根據(ju)《環境(jing)保護法》和(he)國務(wu)院辦公廳《關(guan)于政府向社(she)(she)(she)會(hui)力(li)量購買服務(wu)的(de)指導意見》(國辦發〔2013〕96號)精神(shen),引導社(she)(she)(she)會(hui)力(li)量廣泛(fan)參與環境(jing)監測,規范(fan)社(she)(she)(she)會(hui)環境(jing)監測機構行為,促進(jin)環境(jing)監測服務(wu)社(she)(she)(she)會(hui)化(hua)(hua)良性發展(zhan),現提出以下(xia)意見:

  一、充分(fen)認識推進(jin)環境監測服(fu)務(wu)社會化的(de)重要(yao)意義(yi)

  (一(yi))環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)(hui)(hui)化(hua)(hua)是(shi)(shi)環(huan)(huan)(huan)(huan)保體制(zhi)機(ji)制(zhi)改革創新的重(zhong)要內容。長期(qi)以來,我(wo)國(guo)實行的是(shi)(shi)由政府有關部門所屬環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)為主開(kai)展監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)活(huo)動的單一(yi)管理體制(zhi)。在(zai)環(huan)(huan)(huan)(huan)境(jing)保護(hu)領域(yu)日益擴(kuo)大、環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)任務(wu)快(kuai)速增加(jia)和(he)環(huan)(huan)(huan)(huan)境(jing)管理要求(qiu)不斷提高的情(qing)況下,推進環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)(hui)(hui)化(hua)(hua)已迫在(zai)眉睫。一(yi)些地方(fang)已經開(kai)展了(le)實踐(jian)探(tan)(tan)索(suo),出(chu)臺(tai)了(le)相(xiang)應的管理辦(ban)法,許(xu)多社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)已經進入環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務(wu)市場(chang)。環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務(wu)的社(she)(she)會(hui)(hui)(hui)化(hua)(hua)既是(shi)(shi)加(jia)快(kuai)政府環(huan)(huan)(huan)(huan)境(jing)保護(hu)職能轉變、提高公(gong)共服(fu)(fu)務(wu)質量和(he)效(xiao)率的必(bi)然要求(qiu),也(ye)是(shi)(shi)理順環(huan)(huan)(huan)(huan)境(jing)保護(hu)體制(zhi)機(ji)制(zhi)、探(tan)(tan)索(suo)環(huan)(huan)(huan)(huan)境(jing)保護(hu)新路的現實需要。引導社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)進入環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)的主戰場(chang),提升政府購買社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務(wu)水(shui)平,有利(li)于整合社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)資源,激發社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)活(huo)力,形成環(huan)(huan)(huan)(huan)保系統環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)和(he)社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)共同(tong)發展的新格局。

  二、指導思想與基本原則(ze)

  (二)指導思想(xiang)。以黨的十八(ba)大和十八(ba)屆三中、四中全會(hui)(hui)精(jing)神為指導,強化政(zheng)(zheng)府環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)公(gong)共服(fu)務職(zhi)能,加快轉變環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)職(zhi)能,推進政(zheng)(zheng)事(shi)分開和政(zheng)(zheng)社(she)分開,鼓勵引導社(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)力量廣泛參與,創(chuang)新環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)公(gong)共服(fu)務供給模式,強化環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)事(shi)中事(shi)后監(jian)(jian)(jian)管,形(xing)成以環(huan)保系統環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)機構為骨干、社(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)力量共同參與的環(huan)境(jing)監(jian)(jian)(jian)測(ce)(ce)管理新體(ti)制。

  (三)基(ji)本原則

  ——積極引導(dao)。堅持(chi)從實際出發,放寬準入(ru)條件,充分發揮政府的主導(dao)作(zuo)用和市場(chang)在資(zi)源配置中的決定性作(zuo)用,激勵社會環(huan)境監(jian)測(ce)(ce)機構提(ti)供監(jian)測(ce)(ce)服務(wu)供給。

  ——加快培育。積極培育環(huan)境(jing)(jing)監測服(fu)務(wu)市場,營(ying)造(zao)公平競爭的市場環(huan)境(jing)(jing),有序放開(kai)(kai)環(huan)境(jing)(jing)監測服(fu)務(wu)業務(wu)領域(yu),推動環(huan)境(jing)(jing)監測服(fu)務(wu)社會化工作穩(wen)步(bu)開(kai)(kai)展。

  ——規(gui)范管理(li)(li)。建立完(wan)善環(huan)(huan)境(jing)監測(ce)服務社(she)會化(hua)管理(li)(li)規(gui)章制(zhi)度,約束(shu)環(huan)(huan)境(jing)監測(ce)服務行為,促進(jin)社(she)會環(huan)(huan)境(jing)監測(ce)機構不斷提高環(huan)(huan)境(jing)監測(ce)質量和管理(li)(li)水平。

  ——依法(fa)監(jian)(jian)督。強化環境監(jian)(jian)測(ce)行為(wei)的(de)事(shi)中、事(shi)后監(jian)(jian)管,實(shi)施(shi)對社會環境監(jian)(jian)測(ce)機構(gou)及其(qi)監(jian)(jian)測(ce)服(fu)務行為(wei)的(de)監(jian)(jian)督管理(li),建立正(zheng)常的(de)退(tui)出機制(zhi),維護(hu)環境監(jian)(jian)測(ce)服(fu)務市場的(de)正(zheng)常秩序。

  三、開放環境監測服務(wu)市場

  (四)全面(mian)放開(kai)服(fu)務(wu)性(xing)監(jian)(jian)測(ce)(ce)(ce)市(shi)場。凡適(shi)合(he)社(she)會力量承擔的服(fu)務(wu)性(xing)環(huan)境(jing)監(jian)(jian)測(ce)(ce)(ce)業(ye)務(wu),要創(chuang)造條件,全面(mian)放開(kai)。鼓勵社(she)會環(huan)境(jing)監(jian)(jian)測(ce)(ce)(ce)機構參與(yu)排污單(dan)位(wei)污染(ran)源自行監(jian)(jian)測(ce)(ce)(ce)、環(huan)境(jing)損害評估(gu)監(jian)(jian)測(ce)(ce)(ce)、環(huan)境(jing)影響評價現狀監(jian)(jian)測(ce)(ce)(ce)、清(qing)潔生產審核、企事業(ye)單(dan)位(wei)自主調查等環(huan)境(jing)監(jian)(jian)測(ce)(ce)(ce)活動(dong),推進環(huan)境(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)務(wu)主體多元化(hua)和服(fu)務(wu)方式多樣化(hua)。

  (五)有序放開公益性、監(jian)(jian)(jian)(jian)(jian)督性監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)領域。各級環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護(hu)行政主(zhu)管(guan)部(bu)門所(suo)屬環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)機(ji)構應認真做好所(suo)承(cheng)擔(dan)的(de)政府監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)職能,包(bao)括環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)、預報預警(jing)、跨(kua)境(jing)(jing)(jing)(jing)水體監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)、履約監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)、污(wu)染(ran)源監(jian)(jian)(jian)(jian)(jian)督性監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)、突發環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)事件(jian)應急監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce),以及(ji)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)執(zhi)法、環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)目標責(ze)任考核、排污(wu)費(fei)征收(shou)、總(zong)(zong)量(liang)(liang)核算等(deng)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)管(guan)中的(de)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)工作(zuo)。同時(shi),可以根據財政部(bu)、民政部(bu)和工商(shang)總(zong)(zong)局關于政府購(gou)買(mai)服務(wu)的(de)總(zong)(zong)體要求,將社會(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)機(ji)構能夠(gou)承(cheng)擔(dan),又不(bu)影響公平公正(zheng)原(yuan)則的(de)相關業務(wu),積(ji)極穩妥(tuo)、因地制宜地向(xiang)社會(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)機(ji)構有序放開,包(bao)括環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)自(zi)動監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)站(zhan)和污(wu)染(ran)源自(zi)動監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)(ce)設施的(de)運(yun)行維護(hu)、固體廢物(wu)和危(wei)險(xian)廢物(wu)鑒(jian)別等(deng)監(jian)(jian)(jian)(jian)(jian)(檢)測(ce)(ce)(ce)(ce)(ce)(ce)業務(wu)。

  四(si)、扶(fu)持和(he)規(gui)范(fan)社會環(huan)境監測機構發(fa)展

  (六)轉變管(guan)理(li)(li)方(fang)式(shi)。凡適合(he)社會(hui)(hui)力(li)量承(cheng)擔的(de)(de),環(huan)境(jing)保護行(xing)政(zheng)(zheng)主管(guan)部門均可依據本行(xing)政(zheng)(zheng)區實際,選擇采取(qu)委托、承(cheng)包、采購、名錄管(guan)理(li)(li)等方(fang)式(shi)交由社會(hui)(hui)力(li)量承(cheng)擔。同時,要加強對社會(hui)(hui)環(huan)境(jing)監測(ce)機構事中和(he)事后監管(guan),會(hui)(hui)同相關部門共同出臺相關管(guan)理(li)(li)政(zheng)(zheng)策和(he)辦法(fa),推動環(huan)境(jing)監測(ce)服務(wu)社會(hui)(hui)化(hua)(hua)(hua)工作(zuo)的(de)(de)制度(du)化(hua)(hua)(hua)、體系(xi)化(hua)(hua)(hua)、規范化(hua)(hua)(hua)。

  (七(qi))扶持(chi)行業發展(zhan)(zhan)。要充分發揮環(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)行業協會(hui)或第三方(fang)機構(gou)的(de)作(zuo)用,強化社(she)會(hui)環(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機構(gou)的(de)行業管理,簽訂質量(liang)保證(zheng)承諾,推動行業自律。組織開(kai)展(zhan)(zhan)社(she)會(hui)環(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)技(ji)術人員業務(wu)(wu)(wu)培訓(xun)、業務(wu)(wu)(wu)比武,評估社(she)會(hui)環(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機構(gou)的(de)業務(wu)(wu)(wu)水(shui)平(ping),促(cu)進環(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)行業水(shui)平(ping)的(de)不斷提升。

  (八(ba))加強(qiang)誠信建設。社(she)會環境(jing)監(jian)(jian)測(ce)機構應對所(suo)提供監(jian)(jian)測(ce)數據的真實性(xing)和(he)準確性(xing)負責,建立(li)健(jian)全(quan)質量保證和(he)質量控制體系,嚴(yan)格執行(xing)(xing)(xing)國家和(he)地方(fang)的法律法規、標準和(he)技(ji)術(shu)(shu)(shu)規范,規范環境(jing)監(jian)(jian)測(ce)行(xing)(xing)(xing)為(wei)。加強(qiang)技(ji)術(shu)(shu)(shu)人員(yuan)(yuan)培訓,鼓(gu)勵監(jian)(jian)測(ce)技(ji)術(shu)(shu)(shu)人員(yuan)(yuan)積極參加省級及以上環境(jing)保護行(xing)(xing)(xing)政(zheng)主管部門認可的業務培訓。主動(dong)公(gong)開信息,自覺接(jie)受社(she)會公(gong)眾和(he)環保部門監(jian)(jian)督,提高誠信意識和(he)服務水平。

  五、依(yi)法(fa)監督環境監測服務(wu)行(xing)為(wei)

  (九)完善(shan)監(jian)管機(ji)制(zhi)。省級(ji)環(huan)境保護行政主管部門應(ying)完善(shan)日常(chang)監(jian)督(du)檢查機(ji)制(zhi),加(jia)強過程監(jian)管和信息公(gong)開,定(ding)(ding)期(qi)和不定(ding)(ding)期(qi)地檢查社會(hui)(hui)(hui)環(huan)境監(jian)測(ce)(ce)機(ji)構(gou)(gou)的(de)監(jian)測(ce)(ce)質量,公(gong)布社會(hui)(hui)(hui)環(huan)境監(jian)測(ce)(ce)機(ji)構(gou)(gou)概(gai)況(kuang)和環(huan)境監(jian)測(ce)(ce)服務行為監(jian)督(du)檢查結果,建立公(gong)示制(zhi)度和退(tui)出(chu)機(ji)制(zhi)。完善(shan)社會(hui)(hui)(hui)環(huan)境監(jian)測(ce)(ce)服務機(ji)構(gou)(gou)信用(yong)記錄,社會(hui)(hui)(hui)環(huan)境監(jian)測(ce)(ce)機(ji)構(gou)(gou)及其(qi)法定(ding)(ding)代表人在環(huan)境監(jian)測(ce)(ce)服務活(huo)動(dong)中存在不規范監(jian)測(ce)(ce)行為的(de),環(huan)境保護行政主管部門應(ying)將相應(ying)機(ji)構(gou)(gou)、法人、監(jian)測(ce)(ce)技術人員的(de)違法信息記入社會(hui)(hui)(hui)誠信檔案,并及時向社會(hui)(hui)(hui)公(gong)布。

  (十)強化責任(ren)(ren)追究。社會環(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)在有關環(huan)境(jing)服務活動中弄(nong)虛作假,對造(zao)成(cheng)的(de)(de)(de)環(huan)境(jing)污(wu)染(ran)和(he)生態破壞(huai)負有責任(ren)(ren)的(de)(de)(de),除(chu)依(yi)照有關法律法規規定予以處(chu)罰外,還(huan)應當與(yu)造(zao)成(cheng)環(huan)境(jing)污(wu)染(ran)和(he)生態破壞(huai)的(de)(de)(de)其他責任(ren)(ren)者(zhe)承擔連帶責任(ren)(ren)。對不符合監(jian)(jian)(jian)測(ce)規范、監(jian)(jian)(jian)測(ce)結(jie)果有誤(wu)的(de)(de)(de),給(gei)予通報批評,限期(qi)整(zheng)改;對于存在弄(nong)虛作假行為的(de)(de)(de)或篡改偽(wei)造(zao)監(jian)(jian)(jian)測(ce)數據的(de)(de)(de),依(yi)法予以處(chu)罰,并列入黑名單,抄送(song)質量技術(shu)監(jian)(jian)(jian)督主(zhu)管部門;構(gou)成(cheng)犯罪的(de)(de)(de),依(yi)法追究刑事責任(ren)(ren)。
