關于推進環境監測服務社會化的指導意見
各省(sheng)、自治區、直(zhi)轄(xia)市環境保護(hu)(hu)廳(局),新(xin)疆生產建設兵團環境保護(hu)(hu)局,解放軍環境保護(hu)(hu)局,遼(liao)河保護(hu)(hu)區管(guan)理局:
為全(quan)面(mian)深化(hua)生態(tai)文明(ming)體制改(gai)革(ge),根據《環(huan)境(jing)保護法(fa)》和(he)國(guo)務(wu)(wu)院辦公廳《關于政府向社(she)(she)會(hui)(hui)力量(liang)購買服務(wu)(wu)的指導(dao)意見(jian)》(國(guo)辦發〔2013〕96號(hao))精神,引導(dao)社(she)(she)會(hui)(hui)力量(liang)廣泛參(can)與環(huan)境(jing)監(jian)測,規范社(she)(she)會(hui)(hui)環(huan)境(jing)監(jian)測機(ji)構行為,促進環(huan)境(jing)監(jian)測服務(wu)(wu)社(she)(she)會(hui)(hui)化(hua)良(liang)性發展(zhan),現(xian)提出(chu)以下意見(jian):
一、充分認識推進環境監測服務社(she)會化的重要意(yi)義(yi)
(一)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務社(she)(she)會(hui)(hui)(hui)化是環(huan)(huan)(huan)(huan)保(bao)(bao)體(ti)制(zhi)機(ji)(ji)制(zhi)改(gai)革創新(xin)的(de)(de)(de)(de)重要內容。長(chang)期以來,我國實(shi)(shi)行的(de)(de)(de)(de)是由(you)政府(fu)有(you)關(guan)部門所屬(shu)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)為(wei)主(zhu)開展監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)活動的(de)(de)(de)(de)單一管理體(ti)制(zhi)。在環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護領域日益(yi)擴大、環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)任務快速(su)增加(jia)和環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)管理要求不斷提高(gao)的(de)(de)(de)(de)情況下,推進(jin)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務社(she)(she)會(hui)(hui)(hui)化已迫在眉睫。一些地方已經開展了實(shi)(shi)踐探(tan)索(suo),出臺了相應的(de)(de)(de)(de)管理辦(ban)法(fa),許(xu)多社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)已經進(jin)入環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務市場(chang)。環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務的(de)(de)(de)(de)社(she)(she)會(hui)(hui)(hui)化既是加(jia)快政府(fu)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護職能轉變、提高(gao)公共(gong)服(fu)(fu)務質(zhi)量和效(xiao)率的(de)(de)(de)(de)必然(ran)要求,也是理順環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護體(ti)制(zhi)機(ji)(ji)制(zhi)、探(tan)索(suo)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)(bao)護新(xin)路的(de)(de)(de)(de)現實(shi)(shi)需要。引導(dao)社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)進(jin)入環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)的(de)(de)(de)(de)主(zhu)戰場(chang),提升政府(fu)購買社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)(fu)務水(shui)平(ping),有(you)利于整合社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)資源,激(ji)發社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)活力,形成環(huan)(huan)(huan)(huan)保(bao)(bao)系統(tong)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)和社(she)(she)會(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)(ji)構(gou)共(gong)同發展的(de)(de)(de)(de)新(xin)格局。
二、指導思想與(yu)基本原(yuan)則(ze)
(二)指(zhi)導(dao)(dao)(dao)思(si)想(xiang)。以(yi)黨的(de)十八(ba)大和十八(ba)屆三中、四中全會精神為(wei)指(zhi)導(dao)(dao)(dao),強化政府環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)公共服(fu)務職能(neng),加快轉變環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)職能(neng),推進政事分開和政社分開,鼓(gu)勵引導(dao)(dao)(dao)社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)力量(liang)廣泛參與,創新環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)公共服(fu)務供給模式(shi),強化環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)事中事后監(jian)(jian)管,形(xing)成以(yi)環(huan)(huan)保系統(tong)環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機構為(wei)骨(gu)干、社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)力量(liang)共同參與的(de)環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)管理新體制(zhi)。
(三)基本原則(ze)
——積(ji)極引導(dao)。堅持從實際出(chu)發,放寬準入(ru)條(tiao)件(jian),充分發揮政府的主導(dao)作(zuo)用(yong)和市(shi)場在資源配置(zhi)中的決定性作(zuo)用(yong),激勵社會環(huan)境監測機構(gou)提供監測服(fu)務供給。
——加快培育(yu)。積極培育(yu)環(huan)(huan)境監測服務(wu)(wu)(wu)市場,營造公平競爭的市場環(huan)(huan)境,有序放開環(huan)(huan)境監測服務(wu)(wu)(wu)業務(wu)(wu)(wu)領域,推動環(huan)(huan)境監測服務(wu)(wu)(wu)社會化工作穩步(bu)開展。
——規(gui)范(fan)管理(li)。建立完善(shan)環境(jing)(jing)監(jian)測服(fu)務(wu)(wu)社(she)會化管理(li)規(gui)章制度,約束環境(jing)(jing)監(jian)測服(fu)務(wu)(wu)行為(wei),促(cu)進社(she)會環境(jing)(jing)監(jian)測機構不(bu)斷提(ti)高環境(jing)(jing)監(jian)測質量和管理(li)水平(ping)。
——依法監(jian)(jian)督。強(qiang)化環境監(jian)(jian)測行為的(de)事中、事后(hou)監(jian)(jian)管,實施對社會環境監(jian)(jian)測機構(gou)及其監(jian)(jian)測服(fu)務行為的(de)監(jian)(jian)督管理,建(jian)立(li)正常的(de)退出機制,維護環境監(jian)(jian)測服(fu)務市場(chang)的(de)正常秩序(xu)。
三、開放環境監測服務市場
(四)全面放開服(fu)務(wu)(wu)(wu)性監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)市場。凡(fan)適(shi)合社(she)會力量承擔(dan)的服(fu)務(wu)(wu)(wu)性環(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)業(ye)務(wu)(wu)(wu),要創造條件,全面放開。鼓勵(li)社(she)會環(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構參與排(pai)污單位污染源(yuan)自行監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、環(huan)境(jing)損害評估(gu)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、環(huan)境(jing)影響評價現狀監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、清潔生產審(shen)核、企事業(ye)單位自主(zhu)調(diao)查(cha)等環(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)活動,推(tui)進(jin)環(huan)境(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)主(zhu)體多元(yuan)化(hua)和服(fu)務(wu)(wu)(wu)方式多樣(yang)化(hua)。
(五)有(you)序放(fang)開公(gong)益性(xing)、監(jian)(jian)(jian)(jian)督性(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)領(ling)域。各級環(huan)(huan)境(jing)(jing)(jing)(jing)保(bao)護行(xing)政主管部(bu)門所屬環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構應(ying)(ying)認真做好所承(cheng)擔的(de)(de)政府監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)職能,包(bao)括環(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、預報(bao)預警、跨(kua)境(jing)(jing)(jing)(jing)水(shui)體監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、履約監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、污染(ran)源(yuan)(yuan)監(jian)(jian)(jian)(jian)督性(xing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)、突(tu)發環(huan)(huan)境(jing)(jing)(jing)(jing)事件應(ying)(ying)急監(jian)(jian)(jian)(jian)測(ce)(ce)(ce),以(yi)(yi)及環(huan)(huan)境(jing)(jing)(jing)(jing)執法(fa)、環(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)目標責任(ren)考核、排污費征收、總(zong)量(liang)(liang)核算(suan)等(deng)(deng)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)管中的(de)(de)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)工(gong)作。同(tong)時(shi),可(ke)以(yi)(yi)根(gen)據財政部(bu)、民政部(bu)和工(gong)商(shang)總(zong)局關于(yu)政府購買服務(wu)的(de)(de)總(zong)體要求,將社(she)會環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構能夠承(cheng)擔,又不影響公(gong)平公(gong)正原則的(de)(de)相關業務(wu),積(ji)極穩妥(tuo)、因(yin)地(di)制宜地(di)向(xiang)社(she)會環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構有(you)序放(fang)開,包(bao)括環(huan)(huan)境(jing)(jing)(jing)(jing)質(zhi)量(liang)(liang)自動監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)站(zhan)和污染(ran)源(yuan)(yuan)自動監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)設施的(de)(de)運行(xing)維護、固(gu)體廢物和危(wei)險廢物鑒別等(deng)(deng)監(jian)(jian)(jian)(jian)(檢)測(ce)(ce)(ce)業務(wu)。
四、扶(fu)持和規范社會環(huan)境監測機構發展
(六)轉(zhuan)變管(guan)理方(fang)式。凡適合社(she)會力量承擔(dan)的(de),環境(jing)保護行政主管(guan)部(bu)(bu)門均可依據本(ben)行政區實際,選(xuan)擇采取(qu)委托、承包(bao)、采購、名錄管(guan)理等(deng)方(fang)式交由社(she)會力量承擔(dan)。同時,要加強(qiang)對社(she)會環境(jing)監(jian)測(ce)機構事(shi)中和(he)事(shi)后監(jian)管(guan),會同相(xiang)關部(bu)(bu)門共同出臺相(xiang)關管(guan)理政策(ce)和(he)辦法,推動環境(jing)監(jian)測(ce)服務社(she)會化(hua)(hua)(hua)工作(zuo)的(de)制度化(hua)(hua)(hua)、體系化(hua)(hua)(hua)、規范(fan)化(hua)(hua)(hua)。
(七)扶(fu)持行(xing)業(ye)(ye)發展。要充分發揮環境(jing)(jing)監測行(xing)業(ye)(ye)協會(hui)或(huo)第三方機(ji)構(gou)的作用,強化社會(hui)環境(jing)(jing)監測機(ji)構(gou)的行(xing)業(ye)(ye)管理,簽訂質量保證(zheng)承諾,推動行(xing)業(ye)(ye)自律(lv)。組織開展社會(hui)環境(jing)(jing)監測技術人員(yuan)業(ye)(ye)務培訓、業(ye)(ye)務比武(wu),評估社會(hui)環境(jing)(jing)監測機(ji)構(gou)的業(ye)(ye)務水平,促進環境(jing)(jing)監測服務行(xing)業(ye)(ye)水平的不(bu)斷提升(sheng)。
(八)加強(qiang)誠(cheng)信(xin)建設(she)。社(she)會環(huan)(huan)境監(jian)測機構應對所提供監(jian)測數據(ju)的真實性(xing)和(he)(he)準(zhun)確性(xing)負責,建立健全質量(liang)保(bao)證和(he)(he)質量(liang)控制體系,嚴格執行(xing)國家和(he)(he)地方(fang)的法(fa)律法(fa)規、標準(zhun)和(he)(he)技(ji)術(shu)規范,規范環(huan)(huan)境監(jian)測行(xing)為。加強(qiang)技(ji)術(shu)人(ren)員(yuan)培訓(xun),鼓勵監(jian)測技(ji)術(shu)人(ren)員(yuan)積極參加省級及以上環(huan)(huan)境保(bao)護行(xing)政(zheng)主管部(bu)門(men)認可的業務(wu)培訓(xun)。主動公(gong)開(kai)信(xin)息,自覺接受社(she)會公(gong)眾和(he)(he)環(huan)(huan)保(bao)部(bu)門(men)監(jian)督,提高誠(cheng)信(xin)意識和(he)(he)服務(wu)水平。
五、依法(fa)監督環境監測服務(wu)行為
(九)完(wan)善(shan)監(jian)(jian)管機制。省(sheng)級(ji)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護行(xing)(xing)(xing)政主(zhu)管部(bu)門應(ying)完(wan)善(shan)日常監(jian)(jian)督檢查(cha)機制,加(jia)強過程監(jian)(jian)管和信息公(gong)(gong)開(kai),定期(qi)和不(bu)定期(qi)地檢查(cha)社(she)會(hui)(hui)(hui)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機構(gou)的監(jian)(jian)測(ce)(ce)質量,公(gong)(gong)布(bu)社(she)會(hui)(hui)(hui)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機構(gou)概(gai)況和環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)服務行(xing)(xing)(xing)為(wei)監(jian)(jian)督檢查(cha)結果,建(jian)立公(gong)(gong)示制度和退出機制。完(wan)善(shan)社(she)會(hui)(hui)(hui)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)服務機構(gou)信用記錄(lu),社(she)會(hui)(hui)(hui)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機構(gou)及其法定代表人(ren)在(zai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)服務活(huo)動中存在(zai)不(bu)規范(fan)監(jian)(jian)測(ce)(ce)行(xing)(xing)(xing)為(wei)的,環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護行(xing)(xing)(xing)政主(zhu)管部(bu)門應(ying)將相應(ying)機構(gou)、法人(ren)、監(jian)(jian)測(ce)(ce)技術人(ren)員(yuan)的違法信息記入社(she)會(hui)(hui)(hui)誠信檔(dang)案,并(bing)及時向社(she)會(hui)(hui)(hui)公(gong)(gong)布(bu)。
(十)強(qiang)化責任(ren)(ren)追(zhui)究(jiu)(jiu)。社會環(huan)境(jing)(jing)監(jian)(jian)測機構(gou)在有(you)關(guan)環(huan)境(jing)(jing)服務活動(dong)中弄(nong)虛作(zuo)假(jia),對造(zao)成的(de)(de)環(huan)境(jing)(jing)污(wu)(wu)染和(he)(he)生(sheng)態破壞負有(you)責任(ren)(ren)的(de)(de),除依照有(you)關(guan)法律法規規定予(yu)以處(chu)罰(fa)外,還(huan)應當與(yu)造(zao)成環(huan)境(jing)(jing)污(wu)(wu)染和(he)(he)生(sheng)態破壞的(de)(de)其他責任(ren)(ren)者承擔連帶責任(ren)(ren)。對不符合監(jian)(jian)測規范、監(jian)(jian)測結果(guo)有(you)誤的(de)(de),給予(yu)通報批評,限期整改;對于存在弄(nong)虛作(zuo)假(jia)行(xing)為的(de)(de)或篡改偽造(zao)監(jian)(jian)測數據的(de)(de),依法予(yu)以處(chu)罰(fa),并列入黑(hei)名(ming)單,抄(chao)送質量技術監(jian)(jian)督主(zhu)管部門;構(gou)成犯罪的(de)(de),依法追(zhui)究(jiu)(jiu)刑事責任(ren)(ren)。
