關于推進環境監測服務社會化的指導意見
各省、自治區、直轄市環(huan)(huan)(huan)境保護(hu)(hu)廳(局(ju)),新(xin)疆生產建設(she)兵(bing)團環(huan)(huan)(huan)境保護(hu)(hu)局(ju),解(jie)放軍環(huan)(huan)(huan)境保護(hu)(hu)局(ju),遼河保護(hu)(hu)區管理(li)局(ju):
為(wei)全面深(shen)化(hua)生態文明體制改革,根(gen)據《環境(jing)保護(hu)法》和國務(wu)(wu)院辦公(gong)廳(ting)《關于(yu)政府(fu)向社會(hui)(hui)力量(liang)購買(mai)服務(wu)(wu)的指導(dao)意(yi)(yi)見》(國辦發〔2013〕96號)精神,引導(dao)社會(hui)(hui)力量(liang)廣泛參與(yu)環境(jing)監(jian)測,規范社會(hui)(hui)環境(jing)監(jian)測機構行為(wei),促(cu)進環境(jing)監(jian)測服務(wu)(wu)社會(hui)(hui)化(hua)良性發展,現提出以下(xia)意(yi)(yi)見:
一、充分認識推進環境監測(ce)服(fu)務社(she)會(hui)化的重要意義
(一(yi))環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)社(she)(she)會化是環(huan)(huan)(huan)保(bao)體(ti)(ti)(ti)制(zhi)機(ji)制(zhi)改革創新的(de)(de)(de)(de)重(zhong)要內(nei)容。長期以來(lai),我國實(shi)(shi)行的(de)(de)(de)(de)是由政府(fu)有(you)關部(bu)門(men)所屬環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)為主開(kai)展(zhan)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)活動的(de)(de)(de)(de)單(dan)一(yi)管(guan)理體(ti)(ti)(ti)制(zhi)。在(zai)環(huan)(huan)(huan)境(jing)保(bao)護領域日(ri)益擴大(da)、環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)任(ren)務(wu)(wu)(wu)快速(su)增加(jia)和環(huan)(huan)(huan)境(jing)管(guan)理要求不斷提高的(de)(de)(de)(de)情況下,推進(jin)環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)社(she)(she)會化已(yi)迫在(zai)眉睫(jie)。一(yi)些地方已(yi)經(jing)開(kai)展(zhan)了(le)實(shi)(shi)踐探(tan)索(suo),出臺了(le)相應的(de)(de)(de)(de)管(guan)理辦法,許多社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)已(yi)經(jing)進(jin)入環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)市(shi)場。環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)的(de)(de)(de)(de)社(she)(she)會化既是加(jia)快政府(fu)環(huan)(huan)(huan)境(jing)保(bao)護職能轉變(bian)、提高公共(gong)服(fu)務(wu)(wu)(wu)質量和效率(lv)的(de)(de)(de)(de)必然要求,也(ye)是理順環(huan)(huan)(huan)境(jing)保(bao)護體(ti)(ti)(ti)制(zhi)機(ji)制(zhi)、探(tan)索(suo)環(huan)(huan)(huan)境(jing)保(bao)護新路的(de)(de)(de)(de)現實(shi)(shi)需要。引導社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)進(jin)入環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)的(de)(de)(de)(de)主戰場,提升政府(fu)購買社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)(wu)水(shui)平,有(you)利于整合(he)社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)資(zi)源,激發(fa)社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)活力(li),形成(cheng)環(huan)(huan)(huan)保(bao)系統環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)和社(she)(she)會環(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)共(gong)同發(fa)展(zhan)的(de)(de)(de)(de)新格局。
二、指導思想與基(ji)本原(yuan)則
(二)指導(dao)(dao)思想。以黨的十八大和(he)十八屆三中、四中全(quan)會精神為指導(dao)(dao),強化(hua)政(zheng)府環(huan)(huan)境(jing)(jing)(jing)監(jian)測公共服務職能(neng),加快轉(zhuan)變(bian)環(huan)(huan)境(jing)(jing)(jing)監(jian)測職能(neng),推(tui)進政(zheng)事(shi)(shi)分(fen)開(kai)和(he)政(zheng)社分(fen)開(kai),鼓勵引(yin)導(dao)(dao)社會環(huan)(huan)境(jing)(jing)(jing)監(jian)測力(li)量(liang)廣泛參與,創新(xin)環(huan)(huan)境(jing)(jing)(jing)監(jian)測公共服務供給(gei)模式,強化(hua)環(huan)(huan)境(jing)(jing)(jing)監(jian)測事(shi)(shi)中事(shi)(shi)后監(jian)管,形成以環(huan)(huan)保系統環(huan)(huan)境(jing)(jing)(jing)監(jian)測機構為骨干、社會環(huan)(huan)境(jing)(jing)(jing)監(jian)測力(li)量(liang)共同(tong)參與的環(huan)(huan)境(jing)(jing)(jing)監(jian)測管理新(xin)體制。
(三)基本原則
——積極引導。堅持從實際出(chu)發(fa)(fa),放寬(kuan)準入條件,充分發(fa)(fa)揮政府(fu)的(de)主導作(zuo)用和市(shi)場在資源配置中(zhong)的(de)決(jue)定(ding)性作(zuo)用,激勵社會環境監(jian)測機(ji)構提(ti)供(gong)監(jian)測服務(wu)供(gong)給。
——加快(kuai)培育(yu)。積極培育(yu)環境監測服務(wu)市(shi)(shi)場,營造公平競爭的市(shi)(shi)場環境,有序放(fang)開環境監測服務(wu)業務(wu)領域,推動環境監測服務(wu)社會(hui)化工作穩步開展。
——規范管(guan)(guan)理。建立完善環(huan)境(jing)(jing)監(jian)測服務社(she)(she)會化管(guan)(guan)理規章制度(du),約(yue)束環(huan)境(jing)(jing)監(jian)測服務行為,促(cu)進社(she)(she)會環(huan)境(jing)(jing)監(jian)測機構(gou)不斷(duan)提高環(huan)境(jing)(jing)監(jian)測質量(liang)和管(guan)(guan)理水平。
——依法監(jian)(jian)督(du)(du)。強化環(huan)(huan)境(jing)監(jian)(jian)測行為的(de)事(shi)中、事(shi)后監(jian)(jian)管,實施對社會環(huan)(huan)境(jing)監(jian)(jian)測機構及其監(jian)(jian)測服務行為的(de)監(jian)(jian)督(du)(du)管理,建立正常的(de)退出機制,維(wei)護環(huan)(huan)境(jing)監(jian)(jian)測服務市場的(de)正常秩序。
三、開放環(huan)境監測服務市(shi)場
(四)全(quan)面(mian)放開服(fu)務性(xing)(xing)監(jian)(jian)測市場。凡適合社(she)會(hui)力量承(cheng)擔(dan)的服(fu)務性(xing)(xing)環境(jing)(jing)監(jian)(jian)測業務,要(yao)創造(zao)條件,全(quan)面(mian)放開。鼓勵社(she)會(hui)環境(jing)(jing)監(jian)(jian)測機構參與排污單位(wei)污染源自行監(jian)(jian)測、環境(jing)(jing)損害(hai)評估(gu)監(jian)(jian)測、環境(jing)(jing)影響評價(jia)現(xian)狀監(jian)(jian)測、清潔生產(chan)審核、企事業單位(wei)自主(zhu)調查等環境(jing)(jing)監(jian)(jian)測活動,推(tui)進環境(jing)(jing)監(jian)(jian)測服(fu)務主(zhu)體多元化和(he)服(fu)務方式多樣化。
(五)有(you)序放開公(gong)益性、監(jian)(jian)(jian)督(du)性監(jian)(jian)(jian)測(ce)領域。各級環(huan)境(jing)保護(hu)行政主管部(bu)(bu)門所屬(shu)環(huan)境(jing)監(jian)(jian)(jian)測(ce)機(ji)構應認真(zhen)做好所承擔的(de)政府監(jian)(jian)(jian)測(ce)職能,包括環(huan)境(jing)質量監(jian)(jian)(jian)測(ce)、預(yu)報預(yu)警(jing)、跨境(jing)水(shui)體(ti)監(jian)(jian)(jian)測(ce)、履(lv)約監(jian)(jian)(jian)測(ce)、污染源監(jian)(jian)(jian)督(du)性監(jian)(jian)(jian)測(ce)、突發(fa)環(huan)境(jing)事件應急監(jian)(jian)(jian)測(ce),以及(ji)環(huan)境(jing)執法、環(huan)境(jing)質量目(mu)標(biao)責任考核(he)、排(pai)污費征收(shou)、總量核(he)算等環(huan)境(jing)監(jian)(jian)(jian)管中的(de)監(jian)(jian)(jian)測(ce)工作。同時,可以根據財政部(bu)(bu)、民政部(bu)(bu)和(he)(he)工商總局關于政府購買服務的(de)總體(ti)要求,將社會環(huan)境(jing)監(jian)(jian)(jian)測(ce)機(ji)構能夠承擔,又不(bu)影響公(gong)平公(gong)正原則的(de)相關業務,積極穩妥(tuo)、因地制宜地向社會環(huan)境(jing)監(jian)(jian)(jian)測(ce)機(ji)構有(you)序放開,包括環(huan)境(jing)質量自動(dong)監(jian)(jian)(jian)測(ce)站和(he)(he)污染源自動(dong)監(jian)(jian)(jian)測(ce)設施(shi)的(de)運行維(wei)護(hu)、固體(ti)廢(fei)物和(he)(he)危險廢(fei)物鑒別等監(jian)(jian)(jian)(檢)測(ce)業務。
四、扶持和規范社會環境監(jian)測機構發展
(六)轉變管(guan)(guan)(guan)理(li)(li)方(fang)式。凡適合社會力量承擔的,環(huan)境(jing)保護行(xing)政(zheng)主管(guan)(guan)(guan)部門均可依據本行(xing)政(zheng)區實際,選擇采取委(wei)托、承包、采購、名(ming)錄管(guan)(guan)(guan)理(li)(li)等方(fang)式交由社會力量承擔。同(tong)時,要加(jia)強對社會環(huan)境(jing)監(jian)測(ce)機構事中(zhong)和事后監(jian)管(guan)(guan)(guan),會同(tong)相關部門共同(tong)出臺(tai)相關管(guan)(guan)(guan)理(li)(li)政(zheng)策和辦法,推動環(huan)境(jing)監(jian)測(ce)服務社會化工作的制度化、體系化、規范化。
(七)扶持(chi)行業發展(zhan)。要充(chong)分(fen)發揮環(huan)境監測(ce)(ce)行業協會或第三方(fang)機(ji)構的(de)作用,強化社會環(huan)境監測(ce)(ce)機(ji)構的(de)行業管理,簽訂質量保證(zheng)承諾,推動(dong)行業自(zi)律。組織(zhi)開展(zhan)社會環(huan)境監測(ce)(ce)技術人員(yuan)業務培訓、業務比武(wu),評估社會環(huan)境監測(ce)(ce)機(ji)構的(de)業務水(shui)平(ping),促進環(huan)境監測(ce)(ce)服務行業水(shui)平(ping)的(de)不斷提升。
(八)加強誠信(xin)(xin)建設。社會環境(jing)監(jian)(jian)(jian)測機構(gou)應(ying)對所提供監(jian)(jian)(jian)測數據的(de)真實性和(he)準確性負責(ze),建立健(jian)全(quan)質量保(bao)證和(he)質量控制(zhi)體系,嚴格執(zhi)行國家(jia)和(he)地方的(de)法律(lv)法規(gui)、標準和(he)技(ji)(ji)術規(gui)范(fan),規(gui)范(fan)環境(jing)監(jian)(jian)(jian)測行為。加強技(ji)(ji)術人員(yuan)培(pei)訓,鼓勵監(jian)(jian)(jian)測技(ji)(ji)術人員(yuan)積極參(can)加省級及(ji)以上環境(jing)保(bao)護行政主管部門(men)認(ren)可的(de)業務(wu)培(pei)訓。主動公開信(xin)(xin)息,自覺(jue)接受社會公眾和(he)環保(bao)部門(men)監(jian)(jian)(jian)督,提高誠信(xin)(xin)意(yi)識和(he)服務(wu)水平。
五、依法(fa)監督環境監測服務行(xing)為
(九)完善(shan)監(jian)(jian)(jian)管機(ji)制(zhi)(zhi)。省級(ji)環(huan)(huan)(huan)(huan)境保(bao)護(hu)行(xing)政主管部門(men)應完善(shan)日常監(jian)(jian)(jian)督檢(jian)查機(ji)制(zhi)(zhi),加(jia)強過程監(jian)(jian)(jian)管和信息公開,定期和不定期地檢(jian)查社(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)機(ji)構(gou)(gou)的監(jian)(jian)(jian)測(ce)質量,公布(bu)社(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)機(ji)構(gou)(gou)概況和環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)服(fu)務(wu)行(xing)為監(jian)(jian)(jian)督檢(jian)查結果,建立公示制(zhi)(zhi)度和退(tui)出機(ji)制(zhi)(zhi)。完善(shan)社(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)服(fu)務(wu)機(ji)構(gou)(gou)信用記(ji)錄,社(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)機(ji)構(gou)(gou)及(ji)其(qi)法(fa)定代表人(ren)(ren)在環(huan)(huan)(huan)(huan)境監(jian)(jian)(jian)測(ce)服(fu)務(wu)活動中(zhong)存在不規范監(jian)(jian)(jian)測(ce)行(xing)為的,環(huan)(huan)(huan)(huan)境保(bao)護(hu)行(xing)政主管部門(men)應將(jiang)相應機(ji)構(gou)(gou)、法(fa)人(ren)(ren)、監(jian)(jian)(jian)測(ce)技術人(ren)(ren)員的違法(fa)信息記(ji)入(ru)社(she)(she)會(hui)(hui)(hui)(hui)誠信檔案(an),并及(ji)時(shi)向社(she)(she)會(hui)(hui)(hui)(hui)公布(bu)。
(十)強化責任追(zhui)究。社會環(huan)境監(jian)(jian)測(ce)(ce)機(ji)構(gou)在(zai)有關環(huan)境服務活動中(zhong)弄(nong)虛(xu)作假(jia),對造成的(de)(de)環(huan)境污染(ran)和(he)生態(tai)破壞負有責任的(de)(de),除依照有關法律法規(gui)規(gui)定(ding)予(yu)(yu)以(yi)(yi)處罰外,還應當(dang)與造成環(huan)境污染(ran)和(he)生態(tai)破壞的(de)(de)其他責任者承擔連(lian)帶責任。對不(bu)符合(he)監(jian)(jian)測(ce)(ce)規(gui)范(fan)、監(jian)(jian)測(ce)(ce)結果有誤的(de)(de),給(gei)予(yu)(yu)通報批評,限期(qi)整改;對于存在(zai)弄(nong)虛(xu)作假(jia)行為的(de)(de)或(huo)篡(cuan)改偽造監(jian)(jian)測(ce)(ce)數據(ju)的(de)(de),依法予(yu)(yu)以(yi)(yi)處罰,并列入黑名單,抄送質量技(ji)術監(jian)(jian)督主(zhu)管部(bu)門;構(gou)成犯罪(zui)的(de)(de),依法追(zhui)究刑事(shi)責任。
