關于推進環境監測服務社會化的指導意見
各省、自治區(qu)、直轄市(shi)環境保護(hu)(hu)(hu)廳(ting)(局(ju)(ju)),新疆生(sheng)產建設兵團環境保護(hu)(hu)(hu)局(ju)(ju),解放軍環境保護(hu)(hu)(hu)局(ju)(ju),遼河保護(hu)(hu)(hu)區(qu)管(guan)理局(ju)(ju):
為(wei)全面深化生(sheng)態文明體制改革,根(gen)據《環(huan)境保護法》和(he)國務院辦(ban)(ban)公廳《關(guan)于政府向社(she)(she)會(hui)力量購買(mai)服(fu)務的(de)指導(dao)意(yi)見》(國辦(ban)(ban)發〔2013〕96號)精神,引導(dao)社(she)(she)會(hui)力量廣泛參(can)與環(huan)境監(jian)測(ce),規范(fan)社(she)(she)會(hui)環(huan)境監(jian)測(ce)機(ji)構(gou)行為(wei),促進環(huan)境監(jian)測(ce)服(fu)務社(she)(she)會(hui)化良性發展,現提(ti)出以下意(yi)見:
一、充分認識推進環境(jing)監測服務(wu)社會化的重要意(yi)義
(一(yi)(yi))環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服務社(she)(she)(she)(she)會化(hua)是(shi)環(huan)(huan)(huan)(huan)(huan)保(bao)體(ti)制(zhi)機(ji)(ji)制(zhi)改革創(chuang)新的重要(yao)(yao)(yao)內(nei)容。長期以來,我國(guo)實(shi)行的是(shi)由政(zheng)府有關部(bu)門所屬環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構為主開(kai)展監(jian)(jian)測(ce)(ce)活(huo)(huo)動(dong)的單(dan)一(yi)(yi)管理(li)體(ti)制(zhi)。在環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)(hu)領(ling)域日益擴大、環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)任務快速增加和環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)管理(li)要(yao)(yao)(yao)求不斷提高(gao)的情(qing)況下(xia),推進(jin)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服務社(she)(she)(she)(she)會化(hua)已迫(po)在眉睫。一(yi)(yi)些地方已經開(kai)展了實(shi)踐探索(suo)(suo),出臺了相應的管理(li)辦法,許多社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構已經進(jin)入環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服務市場(chang)(chang)。環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服務的社(she)(she)(she)(she)會化(hua)既是(shi)加快政(zheng)府環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)(hu)職能(neng)轉變(bian)、提高(gao)公共服務質量和效率的必然(ran)要(yao)(yao)(yao)求,也(ye)是(shi)理(li)順環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)(hu)體(ti)制(zhi)機(ji)(ji)制(zhi)、探索(suo)(suo)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保(bao)護(hu)(hu)新路的現實(shi)需要(yao)(yao)(yao)。引(yin)導社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構進(jin)入環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)的主戰場(chang)(chang),提升政(zheng)府購買社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)服務水平,有利(li)于整合社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)資源(yuan),激發社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構活(huo)(huo)力,形成環(huan)(huan)(huan)(huan)(huan)保(bao)系統環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構和社(she)(she)(she)(she)會環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構共同發展的新格局(ju)。
二、指導思想與基本原(yuan)則(ze)
(二)指(zhi)導(dao)思想(xiang)。以黨的(de)十(shi)八(ba)大(da)和(he)十(shi)八(ba)屆三(san)中、四中全會精神(shen)為指(zhi)導(dao),強化(hua)政(zheng)府環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)公(gong)(gong)共服務職能,加(jia)快轉變環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)職能,推進政(zheng)事分開(kai)和(he)政(zheng)社分開(kai),鼓勵引導(dao)社會環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)力量(liang)廣(guang)泛參(can)與,創新環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)公(gong)(gong)共服務供給模式,強化(hua)環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)事中事后監(jian)(jian)(jian)管(guan),形(xing)成以環(huan)(huan)(huan)保系統環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機構為骨(gu)干、社會環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)力量(liang)共同參(can)與的(de)環(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)管(guan)理新體制。
(三)基(ji)本(ben)原則
——積(ji)極引(yin)導(dao)。堅持從實(shi)際出發,放(fang)寬準入條件(jian),充分發揮(hui)政府的主導(dao)作用和市(shi)場在資(zi)源配置中的決定性作用,激(ji)勵社(she)會環境(jing)監測機構提供(gong)監測服務供(gong)給。
——加快培(pei)育。積(ji)極培(pei)育環(huan)境監測服務市(shi)場(chang),營造公平競爭的市(shi)場(chang)環(huan)境,有序放開環(huan)境監測服務業務領域,推動(dong)環(huan)境監測服務社會化工(gong)作穩步開展。
——規范管理。建立完(wan)善環境監(jian)測服(fu)務(wu)社(she)會(hui)化管理規章制度(du),約束環境監(jian)測服(fu)務(wu)行(xing)為,促進社(she)會(hui)環境監(jian)測機構不斷提高環境監(jian)測質量和(he)管理水平。
——依法監督。強化環境(jing)(jing)監測(ce)行(xing)為(wei)的事中、事后監管(guan)(guan),實施對社(she)會(hui)環境(jing)(jing)監測(ce)機構及其監測(ce)服務(wu)行(xing)為(wei)的監督管(guan)(guan)理,建立正(zheng)(zheng)常的退(tui)出(chu)機制,維護環境(jing)(jing)監測(ce)服務(wu)市(shi)場(chang)的正(zheng)(zheng)常秩序。
三、開放環境監測服務市場
(四)全面放開(kai)服務(wu)性監(jian)測(ce)市(shi)場(chang)。凡適合社會力(li)量承擔(dan)的服務(wu)性環(huan)境(jing)監(jian)測(ce)業(ye)務(wu),要創造條(tiao)件,全面放開(kai)。鼓勵社會環(huan)境(jing)監(jian)測(ce)機構參(can)與(yu)排污(wu)單位(wei)污(wu)染(ran)源自行監(jian)測(ce)、環(huan)境(jing)損害評估監(jian)測(ce)、環(huan)境(jing)影響評價現狀(zhuang)監(jian)測(ce)、清潔生產審核、企事業(ye)單位(wei)自主調查(cha)等環(huan)境(jing)監(jian)測(ce)活動,推進環(huan)境(jing)監(jian)測(ce)服務(wu)主體(ti)多(duo)元化(hua)和服務(wu)方式多(duo)樣化(hua)。
(五)有序放開(kai)公(gong)益(yi)性、監(jian)(jian)(jian)(jian)(jian)(jian)督性監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)領域。各級環(huan)(huan)境(jing)保護(hu)行(xing)政(zheng)主(zhu)管(guan)部門所屬環(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)機(ji)構應認真做好所承擔的政(zheng)府監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)職能,包(bao)括環(huan)(huan)境(jing)質量監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)、預報預警(jing)、跨(kua)境(jing)水體(ti)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)、履約監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)、污(wu)染源(yuan)監(jian)(jian)(jian)(jian)(jian)(jian)督性監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)、突發環(huan)(huan)境(jing)事件應急(ji)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce),以及環(huan)(huan)境(jing)執(zhi)法、環(huan)(huan)境(jing)質量目標責(ze)任考(kao)核、排污(wu)費征收、總(zong)量核算等環(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)中的監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)工(gong)(gong)作。同時,可以根據(ju)財(cai)政(zheng)部、民政(zheng)部和工(gong)(gong)商總(zong)局關于政(zheng)府購買服務(wu)(wu)的總(zong)體(ti)要求,將社(she)會環(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)機(ji)構能夠承擔,又不(bu)影響公(gong)平公(gong)正原則的相關業務(wu)(wu),積極穩妥(tuo)、因地制宜地向社(she)會環(huan)(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)機(ji)構有序放開(kai),包(bao)括環(huan)(huan)境(jing)質量自(zi)動監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)站和污(wu)染源(yuan)自(zi)動監(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)設施的運行(xing)維(wei)護(hu)、固體(ti)廢物(wu)和危險廢物(wu)鑒(jian)別等監(jian)(jian)(jian)(jian)(jian)(jian)(檢(jian))測(ce)(ce)(ce)(ce)業務(wu)(wu)。
四、扶持和(he)規(gui)范社會環境監測機構發展
(六(liu))轉(zhuan)變管(guan)理方式(shi)。凡適合社(she)會(hui)力量(liang)承擔的,環(huan)境(jing)保護行(xing)政主管(guan)部(bu)門均可依(yi)據本行(xing)政區實(shi)際,選擇采取委托、承包(bao)、采購、名錄管(guan)理等方式(shi)交(jiao)由(you)社(she)會(hui)力量(liang)承擔。同時(shi),要加強(qiang)對社(she)會(hui)環(huan)境(jing)監(jian)測機構事中和事后監(jian)管(guan),會(hui)同相關(guan)部(bu)門共同出臺相關(guan)管(guan)理政策和辦(ban)法,推(tui)動環(huan)境(jing)監(jian)測服務社(she)會(hui)化(hua)工(gong)作的制度化(hua)、體(ti)系(xi)化(hua)、規(gui)范化(hua)。
(七)扶持行(xing)業(ye)(ye)發展。要充分(fen)發揮環(huan)(huan)(huan)境(jing)監測行(xing)業(ye)(ye)協會或第(di)三(san)方機(ji)(ji)構的作用,強化(hua)社(she)(she)會環(huan)(huan)(huan)境(jing)監測機(ji)(ji)構的行(xing)業(ye)(ye)管理(li),簽訂質量保證承諾,推動行(xing)業(ye)(ye)自律。組織開展社(she)(she)會環(huan)(huan)(huan)境(jing)監測技術人員業(ye)(ye)務(wu)培訓、業(ye)(ye)務(wu)比武,評估社(she)(she)會環(huan)(huan)(huan)境(jing)監測機(ji)(ji)構的業(ye)(ye)務(wu)水(shui)平,促進環(huan)(huan)(huan)境(jing)監測服務(wu)行(xing)業(ye)(ye)水(shui)平的不斷(duan)提升。
(八)加(jia)強誠(cheng)信(xin)建設。社(she)會環境(jing)監(jian)測(ce)機構(gou)應對所提供監(jian)測(ce)數據(ju)的(de)真(zhen)實(shi)性和(he)(he)(he)準確性負(fu)責,建立健(jian)全質量(liang)保(bao)證和(he)(he)(he)質量(liang)控制體系(xi),嚴格執行(xing)國家和(he)(he)(he)地方的(de)法律法規、標準和(he)(he)(he)技(ji)術(shu)規范,規范環境(jing)監(jian)測(ce)行(xing)為。加(jia)強技(ji)術(shu)人員培(pei)訓,鼓勵監(jian)測(ce)技(ji)術(shu)人員積極參加(jia)省級及(ji)以上環境(jing)保(bao)護行(xing)政主管部(bu)門認可的(de)業務培(pei)訓。主動(dong)公開信(xin)息(xi),自(zi)覺接受(shou)社(she)會公眾(zhong)和(he)(he)(he)環保(bao)部(bu)門監(jian)督,提高誠(cheng)信(xin)意(yi)識和(he)(he)(he)服務水平。
五、依(yi)法監(jian)(jian)督(du)環境監(jian)(jian)測(ce)服(fu)務行為
(九)完(wan)善監(jian)(jian)管機制(zhi)(zhi)。省(sheng)級環(huan)(huan)境(jing)(jing)(jing)保護行政主(zhu)管部門(men)應完(wan)善日常(chang)監(jian)(jian)督檢(jian)(jian)查(cha)機制(zhi)(zhi),加強過程監(jian)(jian)管和信(xin)息公開(kai),定期和不定期地檢(jian)(jian)查(cha)社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機構(gou)的(de)(de)監(jian)(jian)測(ce)質量,公布社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機構(gou)概況和環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)服務行為監(jian)(jian)督檢(jian)(jian)查(cha)結果,建立公示(shi)制(zhi)(zhi)度和退(tui)出機制(zhi)(zhi)。完(wan)善社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)服務機構(gou)信(xin)用記錄,社會環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機構(gou)及(ji)其(qi)法(fa)定代表人在環(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)服務活動中(zhong)存在不規范監(jian)(jian)測(ce)行為的(de)(de),環(huan)(huan)境(jing)(jing)(jing)保護行政主(zhu)管部門(men)應將相應機構(gou)、法(fa)人、監(jian)(jian)測(ce)技(ji)術人員(yuan)的(de)(de)違法(fa)信(xin)息記入社會誠信(xin)檔案,并及(ji)時(shi)向社會公布。
(十)強化責(ze)任(ren)追究。社會環(huan)境(jing)監(jian)(jian)測(ce)機構在(zai)(zai)有(you)關(guan)環(huan)境(jing)服(fu)務(wu)活動(dong)中(zhong)弄虛(xu)作(zuo)假(jia),對造成的(de)(de)(de)環(huan)境(jing)污(wu)染和生態破壞負有(you)責(ze)任(ren)的(de)(de)(de),除(chu)依(yi)(yi)照有(you)關(guan)法(fa)律(lv)法(fa)規規定(ding)予(yu)(yu)(yu)以(yi)處罰外,還應當與造成環(huan)境(jing)污(wu)染和生態破壞的(de)(de)(de)其他責(ze)任(ren)者(zhe)承擔連帶(dai)責(ze)任(ren)。對不(bu)符合(he)監(jian)(jian)測(ce)規范(fan)、監(jian)(jian)測(ce)結果有(you)誤的(de)(de)(de),給予(yu)(yu)(yu)通(tong)報批評,限期整改;對于存(cun)在(zai)(zai)弄虛(xu)作(zuo)假(jia)行為的(de)(de)(de)或篡改偽造監(jian)(jian)測(ce)數據的(de)(de)(de),依(yi)(yi)法(fa)予(yu)(yu)(yu)以(yi)處罰,并列入黑名單(dan),抄送質量技術監(jian)(jian)督(du)主管部門;構成犯(fan)罪的(de)(de)(de),依(yi)(yi)法(fa)追究刑事責(ze)任(ren)。
