關于推進環境監測服務社會化的指導意見
各省、自治區、直轄市環境(jing)保(bao)(bao)(bao)護(hu)廳(局),新疆生產建設兵團環境(jing)保(bao)(bao)(bao)護(hu)局,解(jie)放軍環境(jing)保(bao)(bao)(bao)護(hu)局,遼河保(bao)(bao)(bao)護(hu)區管理(li)局:
為全面深化(hua)生(sheng)態文明體制改(gai)革,根(gen)據《環境(jing)保護法》和國(guo)務院辦公(gong)廳《關(guan)于政府向(xiang)社會(hui)力量(liang)(liang)購(gou)買(mai)服務的(de)指導意(yi)見》(國(guo)辦發(fa)〔2013〕96號(hao))精神,引導社會(hui)力量(liang)(liang)廣(guang)泛參與環境(jing)監測(ce),規范社會(hui)環境(jing)監測(ce)機構行為,促進環境(jing)監測(ce)服務社會(hui)化(hua)良性發(fa)展(zhan),現提出以下意(yi)見:
一、充分認識推進環境監測服務社會化的(de)重要意義
(一(yi)(yi))環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)社(she)(she)會(hui)(hui)化是環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)保體(ti)制(zhi)(zhi)機(ji)制(zhi)(zhi)改革創新(xin)的重要內容。長期以(yi)來,我(wo)國實行的是由政(zheng)府(fu)有(you)關(guan)部門所屬環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)為主開展監(jian)(jian)(jian)測(ce)(ce)(ce)活動的單一(yi)(yi)管理(li)體(ti)制(zhi)(zhi)。在(zai)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保護(hu)領(ling)域日益擴大(da)、環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)任務(wu)(wu)快(kuai)速增加和環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)管理(li)要求(qiu)不斷(duan)提高的情(qing)況下,推進環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)社(she)(she)會(hui)(hui)化已迫在(zai)眉睫。一(yi)(yi)些地方已經開展了實踐探(tan)索(suo),出臺了相應的管理(li)辦法,許多社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)已經進入(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)市(shi)場。環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)的社(she)(she)會(hui)(hui)化既是加快(kuai)政(zheng)府(fu)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保護(hu)職能(neng)轉變、提高公共服務(wu)(wu)質量和效率的必然(ran)要求(qiu),也是理(li)順(shun)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保護(hu)體(ti)制(zhi)(zhi)機(ji)制(zhi)(zhi)、探(tan)索(suo)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)保護(hu)新(xin)路的現實需要。引導社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)進入(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)的主戰場,提升(sheng)政(zheng)府(fu)購買社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)水平,有(you)利于整(zheng)合社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)資(zi)源(yuan),激發社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)活力,形成環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)保系統環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)和社(she)(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)(gou)共同發展的新(xin)格局。
二、指導(dao)思想(xiang)與基本原(yuan)則(ze)
(二)指導(dao)思(si)想。以黨的(de)(de)十八大和十八屆三中(zhong)、四中(zhong)全會精神為指導(dao),強化(hua)政府環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)公共(gong)服務(wu)職能,加快轉變環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)職能,推進政事(shi)(shi)分開和政社(she)分開,鼓勵引(yin)導(dao)社(she)會環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)力量廣泛參與(yu),創(chuang)新環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)公共(gong)服務(wu)供給模式,強化(hua)環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)事(shi)(shi)中(zhong)事(shi)(shi)后監(jian)(jian)管,形成以環(huan)(huan)保系統環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)機(ji)構(gou)為骨干(gan)、社(she)會環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)力量共(gong)同(tong)參與(yu)的(de)(de)環(huan)(huan)境(jing)監(jian)(jian)測(ce)(ce)管理新體(ti)制(zhi)。
(三)基本原(yuan)則(ze)
——積(ji)極(ji)引(yin)導。堅持從實際出發,放(fang)寬準入條(tiao)件,充分發揮政府的主導作(zuo)用和市場在資源配置中的決定性(xing)作(zuo)用,激勵社會(hui)環(huan)境監測機(ji)構提供(gong)監測服務供(gong)給。
——加(jia)快培育(yu)。積(ji)極培育(yu)環(huan)(huan)境(jing)監(jian)測(ce)(ce)服務(wu)市場(chang),營造公平競爭(zheng)的市場(chang)環(huan)(huan)境(jing),有序放(fang)開環(huan)(huan)境(jing)監(jian)測(ce)(ce)服務(wu)業務(wu)領(ling)域,推動環(huan)(huan)境(jing)監(jian)測(ce)(ce)服務(wu)社會化工作穩步開展(zhan)。
——規(gui)(gui)范(fan)管(guan)理(li)。建立完善環(huan)境監(jian)(jian)(jian)測服(fu)(fu)務(wu)社會(hui)化管(guan)理(li)規(gui)(gui)章制度,約(yue)束(shu)環(huan)境監(jian)(jian)(jian)測服(fu)(fu)務(wu)行為(wei),促進社會(hui)環(huan)境監(jian)(jian)(jian)測機構不斷提高環(huan)境監(jian)(jian)(jian)測質量和管(guan)理(li)水(shui)平。
——依法(fa)監(jian)督。強(qiang)化(hua)環(huan)(huan)境監(jian)測(ce)行(xing)為的(de)(de)事中、事后(hou)監(jian)管,實施對社會環(huan)(huan)境監(jian)測(ce)機構及其監(jian)測(ce)服(fu)務行(xing)為的(de)(de)監(jian)督管理(li),建立正(zheng)常的(de)(de)退(tui)出(chu)機制,維(wei)護環(huan)(huan)境監(jian)測(ce)服(fu)務市場的(de)(de)正(zheng)常秩序(xu)。
三(san)、開放環境監(jian)測(ce)服務(wu)市場
(四)全面(mian)放開服(fu)(fu)務性監(jian)測(ce)市場。凡適合社(she)(she)會(hui)力量承擔(dan)的服(fu)(fu)務性環境(jing)監(jian)測(ce)業(ye)務,要創造條件(jian),全面(mian)放開。鼓勵社(she)(she)會(hui)環境(jing)監(jian)測(ce)機構(gou)參(can)與排污(wu)單位污(wu)染源自(zi)(zi)行(xing)監(jian)測(ce)、環境(jing)損害評(ping)估監(jian)測(ce)、環境(jing)影響評(ping)價現狀監(jian)測(ce)、清潔生產審核、企事業(ye)單位自(zi)(zi)主調查等環境(jing)監(jian)測(ce)活(huo)動,推進環境(jing)監(jian)測(ce)服(fu)(fu)務主體多元化和服(fu)(fu)務方式多樣化。
(五(wu))有序(xu)放開公(gong)益性(xing)、監(jian)(jian)督性(xing)監(jian)(jian)測(ce)領(ling)域。各級環(huan)境(jing)(jing)(jing)保(bao)護行政主管(guan)部(bu)門所屬(shu)環(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機(ji)構(gou)(gou)應(ying)認(ren)真做好所承(cheng)(cheng)擔的(de)政府(fu)(fu)監(jian)(jian)測(ce)職(zhi)能,包括環(huan)境(jing)(jing)(jing)質(zhi)量監(jian)(jian)測(ce)、預(yu)(yu)報預(yu)(yu)警、跨境(jing)(jing)(jing)水體監(jian)(jian)測(ce)、履(lv)約監(jian)(jian)測(ce)、污染(ran)(ran)源監(jian)(jian)督性(xing)監(jian)(jian)測(ce)、突發環(huan)境(jing)(jing)(jing)事(shi)件應(ying)急監(jian)(jian)測(ce),以及(ji)環(huan)境(jing)(jing)(jing)執法、環(huan)境(jing)(jing)(jing)質(zhi)量目標責任考(kao)核(he)、排污費征收、總量核(he)算等環(huan)境(jing)(jing)(jing)監(jian)(jian)管(guan)中的(de)監(jian)(jian)測(ce)工作(zuo)。同時,可以根據財政部(bu)、民(min)政部(bu)和工商總局關(guan)于政府(fu)(fu)購買服務的(de)總體要求,將社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機(ji)構(gou)(gou)能夠承(cheng)(cheng)擔,又不影響公(gong)平公(gong)正原(yuan)則的(de)相關(guan)業務,積極穩妥、因地制宜地向社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)(jian)測(ce)機(ji)構(gou)(gou)有序(xu)放開,包括環(huan)境(jing)(jing)(jing)質(zhi)量自動(dong)監(jian)(jian)測(ce)站和污染(ran)(ran)源自動(dong)監(jian)(jian)測(ce)設施的(de)運行維護、固(gu)體廢物和危險廢物鑒別等監(jian)(jian)(檢(jian))測(ce)業務。
四、扶持和規范社會環境監測機(ji)構發(fa)展
(六)轉變(bian)管(guan)理方(fang)(fang)式(shi)。凡適(shi)合社(she)(she)(she)會(hui)力量(liang)承擔(dan)的(de),環(huan)境保(bao)護行政主管(guan)部門均可依據本(ben)行政區實際(ji),選擇采(cai)取委(wei)托、承包、采(cai)購、名錄管(guan)理等方(fang)(fang)式(shi)交由(you)社(she)(she)(she)會(hui)力量(liang)承擔(dan)。同時,要(yao)加(jia)強對社(she)(she)(she)會(hui)環(huan)境監(jian)測機構事中和事后監(jian)管(guan),會(hui)同相關部門共同出(chu)臺相關管(guan)理政策和辦法,推動環(huan)境監(jian)測服務社(she)(she)(she)會(hui)化(hua)工作的(de)制度(du)化(hua)、體系(xi)化(hua)、規范化(hua)。
(七)扶持行業(ye)發展。要充分發揮環境(jing)監(jian)(jian)(jian)測(ce)行業(ye)協會或第三方機構的(de)作用,強化社會環境(jing)監(jian)(jian)(jian)測(ce)機構的(de)行業(ye)管理,簽訂質(zhi)量(liang)保證(zheng)承諾,推動行業(ye)自律。組織開展社會環境(jing)監(jian)(jian)(jian)測(ce)技術人員業(ye)務(wu)培訓、業(ye)務(wu)比武,評估社會環境(jing)監(jian)(jian)(jian)測(ce)機構的(de)業(ye)務(wu)水平,促進(jin)環境(jing)監(jian)(jian)(jian)測(ce)服(fu)務(wu)行業(ye)水平的(de)不斷提升。
(八(ba))加強誠(cheng)信(xin)建設。社會(hui)環(huan)境監(jian)(jian)測機(ji)構應對(dui)所提供監(jian)(jian)測數(shu)據(ju)的(de)真實性和準確性負責,建立健全質量(liang)保證和質量(liang)控(kong)制體(ti)系(xi),嚴格(ge)執行(xing)國家和地(di)方的(de)法(fa)律法(fa)規(gui)(gui)、標準和技(ji)術規(gui)(gui)范,規(gui)(gui)范環(huan)境監(jian)(jian)測行(xing)為。加強技(ji)術人員培(pei)訓,鼓勵監(jian)(jian)測技(ji)術人員積極參加省級及以(yi)上環(huan)境保護行(xing)政主管部門認可(ke)的(de)業務(wu)培(pei)訓。主動(dong)公(gong)開信(xin)息,自(zi)覺接受社會(hui)公(gong)眾(zhong)和環(huan)保部門監(jian)(jian)督,提高誠(cheng)信(xin)意識和服務(wu)水平。
五(wu)、依(yi)法監督(du)環境監測服務行(xing)為(wei)
(九)完善監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)機制(zhi)。省級環(huan)境(jing)(jing)(jing)保護行(xing)政(zheng)主(zhu)管(guan)(guan)部(bu)門應完善日常監(jian)(jian)(jian)(jian)(jian)督檢(jian)(jian)查機制(zhi),加強過程(cheng)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)和(he)信息(xi)(xi)公(gong)開,定期和(he)不(bu)定期地檢(jian)(jian)查社會(hui)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構(gou)(gou)的監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)質量(liang),公(gong)布(bu)社會(hui)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構(gou)(gou)概(gai)況和(he)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務行(xing)為監(jian)(jian)(jian)(jian)(jian)督檢(jian)(jian)查結果,建(jian)立公(gong)示制(zhi)度和(he)退出機制(zhi)。完善社會(hui)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務機構(gou)(gou)信用記錄,社會(hui)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機構(gou)(gou)及其法(fa)定代(dai)表(biao)人(ren)在環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務活動中存在不(bu)規范監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)行(xing)為的,環(huan)境(jing)(jing)(jing)保護行(xing)政(zheng)主(zhu)管(guan)(guan)部(bu)門應將相(xiang)應機構(gou)(gou)、法(fa)人(ren)、監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)技術人(ren)員的違法(fa)信息(xi)(xi)記入(ru)社會(hui)誠信檔案,并及時向社會(hui)公(gong)布(bu)。
(十(shi))強化責(ze)(ze)任(ren)追究。社會環(huan)境監(jian)測機(ji)構在有關(guan)環(huan)境服務(wu)活動中(zhong)弄(nong)虛作假,對(dui)(dui)造成(cheng)的(de)環(huan)境污(wu)染和(he)生態破壞(huai)負(fu)有責(ze)(ze)任(ren)的(de),除依照(zhao)有關(guan)法(fa)(fa)律法(fa)(fa)規(gui)(gui)規(gui)(gui)定予以(yi)處罰外,還應(ying)當與造成(cheng)環(huan)境污(wu)染和(he)生態破壞(huai)的(de)其他責(ze)(ze)任(ren)者承擔(dan)連帶責(ze)(ze)任(ren)。對(dui)(dui)不(bu)符(fu)合監(jian)測規(gui)(gui)范、監(jian)測結果(guo)有誤的(de),給予通報批評(ping),限期整(zheng)改(gai);對(dui)(dui)于存在弄(nong)虛作假行為的(de)或篡改(gai)偽造監(jian)測數(shu)據(ju)的(de),依法(fa)(fa)予以(yi)處罰,并列入黑(hei)名單(dan),抄送質(zhi)量技術監(jian)督主管部門(men);構成(cheng)犯罪的(de),依法(fa)(fa)追究刑事責(ze)(ze)任(ren)。

環境(jing)保護部辦公廳2015年2月5日印發
